IMPORTANT INFORMATION – PLEASE READ!

Please read these Terms of Use (“Terms”) carefully. The following is a legal agreement between you (“purchaser”) and the owner of Rachel Brenke Photography, LLC, which governs your use of all forms and templates purchased from this website.

By making this purchase, you agree to be bound by the terms of this Agreement automatically, without any other conditions or declarations. If you do not agree with these terms, you are not allowed to make this purchase.

Products referred to within the Terms are including but not limited to; contract forms, templates, communications, workshops, and any other related items for paid purchase or free download from Rachel Brenke Photography, LLC.

RESPONSIBILITY OF PURCHASER

It is the responsibility of the purchaser to download the product immediately and securely back up all purchases.  The seller is not liable for any loss or damage to products after download.  A $5 re-download fee will be applied if a new download link is requested. All links expires after 5 tries or 120 hours. You must download immediately.

LICENSE

By purchasing you acknowledge that the ownership of the product is not transferred to you and may not be claimed as your own.  Ownership is retained by the seller.

Purchasing and/or downloading through this site gives Rachel Brenke Photography, LLC permission to contact you.

RETURN/REFUND POLICY

You acknowledge that all products are non-refundable and not returnable, under any circumstances.  All sales are final.

MODIFICATIONS

You may modify the product should the need arise but modifications do not expand the license to include ownership and copyright.  All ownership and copyright are retained by the seller.

 

NON-COMPETE AGREEMENT

Workshop attendees are bound by a non-compete and non-disclosure agreement.  Workshop attendees are bound by a perpetual non-disclosure agreement.  Workshop attendees are bound by a six month non-compete agreement including by not limited to online workshops, in person workshop, or workshops given through any other medium for pay or free.

DISCLAIMER OF WARRANTIES AND LIABILITIES

THE FORMS ARE PROVIDED “AS IS”. I OFFER NO WARRANTY, EXPLICIT OR IMPLIED, REGARDING ANY FORMS OR TEMPLATES, THE ACCURACY OF ANY INFORMATION, OR ANY RIGHTS OR LICENSES UNDER THIS AGREEMENT INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

RACHEL BRENKE PHOTOGRAPHY, LLC SHALL NOT BE LIABLE TO YOU OR TO ANY OTHER PERSON OR ENTITY FOR ANY GENERAL, PUNITIVE, SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES, OR LOST PROFITS OR ANY OTHER DAMAGES, COSTS OR LOSSES ARISING OUT OF YOUR USE OF THE WEBSITE OR PRODUCTS.

Seller reserves the right to change or modify the terms of use at any time.
